Before You Make Plans

Before signing a new lease, disconnecting utilities, moving out, allowing someone to move in, advertising your room, or making travel arrangements, contact Azure Sky Realty. Many lease changes require advance approval and documentation. Early communication often provides more options and helps avoid delays, fees, or misunderstandings.


Life circumstances change, and sometimes the people living in a home change as well. Whether you are adding a spouse, replacing a roommate, removing a former occupant, adding an adult child who has turned 18, or making another change to the residents listed on the lease, the change must be approved and documented through a formal lease amendment.

Because everyone listed on the lease has legal rights and responsibilities under the lease agreement, occupancy changes cannot be made informally. Changes are not effective until all required approvals have been obtained and the amendment has been fully executed.

Changes to Lease Occupants

Eligibility Requirements

Before Azure Sky Realty will process a request to add, remove, or replace a lease occupant, the lease account must be in good standing. Any proposed new resident must satisfy applicable qualification requirements and receive approval through the application process.

Approval of a new resident does not automatically approve the occupancy change. All required parties must agree to the amendment, and all required documentation must be completed before the change becomes effective.

Adding a New Roommate

Any individual who will become a resident under the lease must complete the application process and meet the property's qualification requirements. This applies whether the new resident is a traditional roommate, spouse, family member, partner, or any other adult who will be occupying the property.

New residents may not move into the property until they have been approved, all required documents have been completed, and the occupancy change has become effective.

Removing or Replacing a Roommate

When a resident moves out before the end of the lease term, a formal amendment is required to remove that individual from the lease. If another resident is taking their place, the incoming resident must complete the application and approval process before the amendment can be finalized.

Once the amendment becomes effective, the departing resident is released from future liability under the lease. Any guarantor associated with that resident is also released from future liability unless otherwise agreed in writing. Remaining residents and any newly added residents continue to be responsible for the lease and all obligations associated with it.

Security Deposits

Security deposits are associated with the lease rather than any individual resident. As a result, security deposits are generally not refunded when a resident moves out during the lease term.

When a new resident is added to a lease, that resident acquires an interest in the existing security deposit being held under the lease. Any refundable portion of the security deposit will be handled at the end of the tenancy in accordance with the lease agreement and applicable law, less any lawful deductions.

If a departing resident wishes to recover their share of the deposit before the lease ends, arrangements should be made directly between the departing resident, remaining residents, and any incoming resident. Azure Sky Realty does not determine how security deposits are divided among current, former, or incoming residents.

Residents should also understand that damages caused during the tenancy become the responsibility of the residents who remain on the lease. Because Azure Sky Realty continues to hold the security deposit until the tenancy ends, residents are encouraged to inspect the property together and discuss any existing damage before a resident departs. Pet deposits are treated as part of the overall security deposit and remain with the lease until final move-out. If an incoming resident has a pet, the animal must be approved and any required deposits, fees, or pet rent must be paid before occupancy.

Fees and Additional Costs

A $200 administrative fee applies for each action involving the addition, removal, or replacement of a lease occupant.

Residents may also request that exterior door locks be rekeyed when a resident moves out. Rekeying is optional and performed at the residents' expense. Costs vary based on the number of locks involved and current vendor pricing. Residents requesting rekeying should expect charges to be based on the total number of doors being rekeyed.

Important Reminder

A change in occupancy is not complete simply because someone has moved in or moved out. The original lease remains in effect until all required applications have been approved, all required fees have been paid, all required signatures have been obtained, and the amendment has been fully executed.

Residents should plan ahead and allow adequate time for processing. Occupancy changes often require multiple approvals, documents, and signatures and may take one to two weeks or longer to complete.

Individuals who move into the property before approval and execution of the amendment may be considered unauthorized occupants under the lease and may be subject to lease violations, fees, penalties, or other remedies available under the lease agreement.

Lease Transfers & Assignments

When Someone Wants to Take Over the Entire Lease

A lease transfer or assignment occurs when all current residents wish to move out and another individual or household wishes to take over the lease. Unlike a typical occupancy change, where one or more existing residents remain on the lease, a lease transfer results in all existing residents being removed and replaced with new residents.

Because lease agreements create legal obligations for both residents and property owners, lease transfers require approval and cannot be completed informally.

How the Process Works

Lease transfers are processed using the same amendment procedures used for occupancy changes. Existing residents are removed from the lease and new residents are added through a series of lease amendments until the lease reflects only the new household.

All incoming residents must complete the application process and satisfy the property's qualification requirements before any transfer can be approved. The lease account must also be in good standing before transfer documents will be prepared.

Because multiple applications, approvals, amendments, and signatures are often required, residents should begin the process as early as possible and provide a desired effective date when submitting their request.

Security Deposits

Security deposits remain with the lease and are not refunded as part of a lease transfer. Any refundable portion of the security deposit will continue to be held until the tenancy ultimately ends and will be handled in accordance with the lease agreement and applicable law.

As part of the transfer process, the incoming residents acquire an interest in the existing security deposit being held under the lease. Residents should understand that Azure Sky Realty does not determine how security deposits are divided between departing and incoming households.

If damages exist at the property that may result in future deductions from the security deposit, the departing and incoming residents are encouraged to inspect the property together and reach any agreements they feel are appropriate regarding compensation. Azure Sky Realty is not a party to those discussions and does not participate in negotiating or enforcing private agreements between residents.

Pet deposits are treated similarly and remain with the lease. If incoming residents have pets, those pets must be approved and any required pet deposits, fees, or pet rent must be paid before occupancy.

Transfer Fees

Lease transfers require administrative processing, application review, screening, document preparation, and coordination among all parties. Because the complexity of a transfer often increases with the size of the property and the number of residents involved, Azure Sky Realty utilizes a transfer fee based on the monthly rent rather than a flat fee.

The lease transfer fee is equal to 35% of one month's rent.

This fee applies when the current resident(s) identify their own replacement resident(s) and Azure Sky Realty's role is limited to processing the transfer, reviewing applications, preparing documents, obtaining signatures, and completing the transfer process.

Transfer fees are separate from application fees and must be paid before transfer documents will be prepared.

Optional Marketing & Representation Services

Some residents prefer to locate their own replacement resident, while others would like professional assistance marketing the property and identifying qualified applicants.

Azure Sky Realty may be able to provide optional brokerage and marketing services to assist with finding a replacement resident. These services are separate from the lease transfer process and may require a separate representation agreement.

Marketing assistance is not included in the standard lease transfer fee. If you would like assistance advertising the property, scheduling showings, or locating qualified replacement residents, please contact our office to discuss available options and associated costs.

Important Reminder

Regardless of who identifies the replacement resident, all incoming residents must complete the application process and satisfy the property's qualification requirements. The lease account must also be in good standing before a transfer can be approved. The transfer does not become effective until all incoming residents have been approved, all required fees have been paid, all required documents have been signed, and the transfer has been fully executed by Azure Sky Realty.

Incoming residents should not move into the property before the transfer has been completed and the effective date has arrived. Individuals occupying a property before approval may be considered unauthorized occupants under the lease and could be subject to fees, penalties, or lease violations.

Subleasing

Sometimes life requires a temporary relocation. Whether you're leaving for an internship, a work assignment, military training, or another extended absence, a sublease may allow you to bring in an approved occupant while preserving your ability to return to the property later. Because subleasing affects the rights and responsibilities of all residents, prior approval and documentation are required.

How Subleasing Works

Because a sublease is intended to be temporary, Azure Sky Realty typically handles subleasing through a pair of lease amendments designed to clearly establish both the beginning and end of the sublease period. Rather than removing the original resident from the lease, the subtenant is temporarily added to the lease for an approved period of time while the original resident remains a leaseholder.

To accomplish this, the subtenant must complete the application process and satisfy the property's qualification requirements. The lease account must be in good standing, and all current residents must agree to the arrangement before the request can be approved.

Once approved, lease amendment documents are prepared that establish the sublease period and identify when the subtenant will be removed from the lease. In most situations, both amendments are signed at the beginning of the process so that all parties clearly understand the approved occupancy period and the planned return of the original resident.

This approach provides clarity for residents, property owners, and management by establishing who is authorized to occupy the property during the sublease period and when the original occupancy arrangement will resume. It also helps avoid confusion regarding lease obligations, security deposits, property condition, and responsibility for damages during the approved sublease term.

The sublease does not become effective until all required applications have been approved, all required fees have been paid, and all required lease documents have been fully executed. Residents should plan ahead, as the approval and documentation process may take one to two weeks or longer depending on the circumstances.

When a Resident Plans to Return

Subleasing is most commonly used when a resident expects to return to the property after a temporary absence. Unlike a lease transfer, where the lease is permanently assigned to another individual, a sublease allows the original resident to maintain their lease rights while an approved subtenant occupies the property for a defined period of time.

Because the original resident remains on the lease, they do not give up their interest in the property or their right to return when the approved sublease period ends. This can be beneficial for residents leaving for a summer internship, study abroad program, temporary work assignment, military training, or another short-term commitment.

Although the subtenant will be authorized to occupy the property during the approved sublease period, the original resident remains a party to the lease and continues to share responsibility for complying with its terms. For that reason, subleasing requires careful planning, approval from all affected parties, and clear documentation establishing when the sublease begins and when it ends.

Approval Requirements

Because a sublease affects every resident on the lease and introduces an additional occupant to the property, approval is required before a sublease can begin. Approval is not automatic and residents should not make commitments or allow a subtenant to move into the property until the process has been completed.

To be eligible for approval, the lease account must be in good standing and all current residents must consent to the proposed sublease arrangement. Any proposed subtenant must complete the application process and satisfy the property's qualification requirements, including any applicable income, credit, rental history, guarantor, and screening requirements.

If the proposed subtenant has a pet, the pet must also be approved in accordance with the property's Pet Policy. Additional pet deposits, fees, or pet rent may apply.

All required fees must be paid and all required lease amendment documents must be fully executed before the sublease becomes effective. Residents should allow adequate time for application processing, document preparation, signatures, and final approval. In most cases, the process may take one to two weeks or longer depending on the circumstances.

A sublease is not approved until Azure Sky Realty has completed its review and executed all required documentation. Unauthorized occupants may constitute a lease violation and may result in fees, penalties, or other remedies available under the lease agreement.

Responsibility During the Sublease

A sublease allows a temporary occupant to reside in the property, but it does not remove the original resident from the lease. Throughout the approved sublease period, the original resident remains a leaseholder and continues to share responsibility for complying with all terms of the lease agreement.

This means that rent, lease violations, property damage, unpaid charges, pet-related issues, and other lease obligations remain the responsibility of the residents on the lease, regardless of any private arrangements made between the resident and the subtenant. While residents may choose to establish their own agreements regarding rent payments, utilities, furnishings, cleaning responsibilities, or other matters, Azure Sky Realty is not a party to those arrangements and will continue to look to the leaseholders for compliance with the lease.

Because the original resident intends to return to the property at the conclusion of the sublease period, residents should carefully discuss expectations before entering into a sublease arrangement. This may include addressing the condition of the property, the handling of personal belongings, cleaning responsibilities, utility arrangements, parking, and any other matters that could affect the return of the original resident.

Residents should also understand that security deposits are not refunded, divided, or reissued as part of a sublease. Any damages that occur during the approved sublease period may ultimately affect the security deposit held under the lease, and all leaseholders remain responsible for the condition of the property.

A sublease can be an effective solution for a temporary absence, but it works best when all parties clearly understand their responsibilities and maintain open communication throughout the approved sublease period.

Fees and Costs

Subleases require application review, screening, document preparation, administrative processing, and coordination among all parties. Because a sublease typically involves both the temporary addition of a subtenant and the future removal of that same subtenant, Azure Sky Realty prepares the necessary documentation for the entire approved sublease period at the beginning of the process.

The administrative fee for a sublease is $300 per subtenant. This fee covers the preparation and processing of both the amendment adding the subtenant to the lease and the amendment removing the subtenant at the end of the approved sublease period. The fee reflects a discounted rate compared to processing the two lease modifications separately.

Application fees, screening fees, pet-related fees, pet deposits, pet rent, and other charges may apply separately where applicable. Any required fees must be paid before sublease documents will be prepared and submitted for signature.

Residents should understand that the sublease fee covers the administrative processing of the request and does not include brokerage, marketing, or tenant placement services. Residents remain responsible for locating their own subtenant unless separate arrangements are made with Azure Sky Realty.

If additional occupants are being added, multiple subtenants are involved, the approved sublease period changes after documents have been prepared, or additional amendments become necessary, additional fees may apply.

Subleasing FAQ


Residents occasionally need to move before their lease term ends due to job changes, transfers, family circumstances, home purchases, or other life events. While we understand these situations occur, moving out of the property does not automatically end the lease or release a resident from their contractual obligations.

Under the lease, residents remain responsible for rent, utilities, lawn care, and all other lease obligations through the end of the lease term unless a written agreement is executed by all required parties. Residents may not apply their security deposit toward rent, including the final month's rent, without prior written approval. Security deposits are held and accounted for in accordance with the lease and applicable law.

Important: Moving out and ending a lease are not the same thing.

Early Move-Outs and Lease Obligations

Moving Out Before the Lease Ends

Residents may vacate the property before the lease expiration date, but doing so does not terminate the lease. Unless an approved lease transfer, sublease arrangement, or written early termination agreement is completed, the resident remains responsible for all obligations under the lease through the scheduled end date.

This includes:

  • Monthly rent payments

  • Required utilities

  • Lawn care and other resident-maintained services

  • Property condition and damage responsibilities

  • Compliance with all lease terms

Abandonment of the Property

If a resident vacates the property without completing an approved transfer, sublease, or termination agreement, the situation may be considered abandonment under the lease. The Texas Apartment Association lease defines abandonment based on several factors, including vacancy of the property, nonpayment of rent, and failure to respond to notices.

If abandonment or certain other default situations occur, the lease provides that:

  • Remaining rent may be accelerated and become immediately due.

  • A reletting charge may be assessed (up to 85% of one month's rent as specified in the lease).

  • Additional damages, costs, attorney fees, and other amounts allowed by the lease may also be charged.

The reletting charge is not a buyout fee and does not release a resident from liability under the lease.

Security Deposits and Rent

Security deposits cannot be used in place of rent payments. Residents must continue paying rent as required by the lease, and the security deposit will be processed after move-out in accordance with the lease and Texas law.

Early Termination by Agreement

In limited circumstances, a resident and property owner may mutually agree to end a lease before its scheduled expiration date. These situations are reviewed individually and are not guaranteed.

If approved, all required parties must execute a written lease termination agreement. Depending on the circumstances, the agreement may require payment of an early termination fee, reimbursement of vacancy costs, utility expenses, marketing costs, or other amounts that would otherwise remain the resident's responsibility through the end of the lease term.

Residents considering an early move-out should contact Azure Sky Realty as soon as possible to discuss available options, including lease transfers, subleasing, or a potential early termination request.

We appreciate the sacrifices made by those who serve our country and are committed to helping military residents understand the housing protections and responsibilities available under applicable law.

Military lease terminations are governed by federal law and specific documentation requirements. The information below is intended to provide a general overview of the process, but every situation is unique. Residents receiving military orders should contact Azure Sky Realty as early as possible so we can review their circumstances and discuss available options.

Eligibility Requirements

Military lease terminations are governed by federal law and typically require qualifying military orders along with written notice from the resident. Eligibility for military lease termination rights is determined based upon the specific facts, documentation provided, and applicable law.

The effective termination date is determined in accordance with applicable law and the lease agreement and may not be the same date that notice is submitted.

Not all military orders qualify for early lease termination rights. Certain training assignments, temporary duty assignments, or other military-related activities may not meet the legal requirements for lease termination. For example, residents occasionally assume that enlistment, basic training, boot camp, ROTC participation, or other military-related activities automatically qualify for military lease termination rights. In many cases, the applicable law requires specific qualifying orders, such as a permanent change of station (PCS) or qualifying deployment orders. Because eligibility depends on the specific facts and documentation involved, residents should contact Azure Sky Realty before making moving arrangements or assuming that a military termination right exists.

Important: Military service does not automatically terminate a lease. Qualifying orders and documentation are required, and not all military-related assignments or training programs create termination rights under federal law.

Documentation and Notice

Residents requesting a military lease termination should submit:

• Written notice requesting termination under the Servicemembers Civil Relief Act (SCRA);

• A copy of qualifying military orders or, if final orders have not yet been issued, other documentation permitted by law, including a letter from the resident's commanding officer when applicable;

• The anticipated move-out date and the date possession of the property will be surrendered;

• A forwarding address and instructions regarding the security deposit.

Additional information may be requested if needed to verify eligibility or determine the appropriate termination date.

Until the termination process has been completed, residents remain responsible for complying with the lease agreement, including rent payments and other lease obligations.

Effective Date of Termination

The effective termination date for a qualifying military termination is determined by applicable federal and Texas law and may not be the same date that notice is submitted. In many cases, the lease terminates 30 days after the next rent payment due date following delivery of the required notice and documentation, although certain circumstances may be governed by different rules.

Security Deposits and Property Condition

Military termination rights do not eliminate responsibility for damages, cleaning charges, unpaid rent, utility charges, or other lawful deductions that may exist at the time of move-out. Security deposits are processed in accordance with the lease agreement and applicable law after possession of the property has been returned.

Residents should continue to follow all move-out procedures, including providing forwarding information, returning keys, and removing personal belongings from the property.

Important Reminder

Military terminations are subject to specific legal requirements regarding notice, documentation, and effective dates. Residents should avoid making assumptions about their termination date and should work directly with Azure Sky Realty to ensure all requirements have been satisfied before making final moving arrangements. Submission of documentation does not automatically establish eligibility for military lease termination rights or determine the effective termination date.

The loss of a family member, roommate, or loved one is never easy. Azure Sky Realty understands that the death of a resident can create uncertainty regarding housing, lease obligations, personal belongings, and next steps. Our goal is to work with surviving residents, family members, authorized representatives, and property owners to navigate the process with professionalism, compassion, and respect.

Because every situation is unique, we encourage family members or authorized representatives to contact Azure Sky Realty as soon as practical so that we can discuss the circumstances and explain the documentation that may be required.

Notification and Documentation

When a resident passes away, Azure Sky Realty should be notified as soon as reasonably possible. Depending on the circumstances, we may request documentation such as a death certificate, letters testamentary, letters of administration, court orders, or other documentation establishing the authority of an executor, administrator, or other authorized representative.

The documentation requirements may vary depending on whether the deceased resident was the sole resident on the lease or one of several residents occupying the property.

Because lease records, account information, and personal information are confidential, Azure Sky Realty may require documentation establishing legal authority before discussing account details, granting access to the property, releasing personal property, accepting instructions regarding the lease, or taking other actions related to the tenancy. The documentation required may vary depending on the circumstances and the individual requesting access or information.

If Other Residents Remain in the Property

When a lease includes multiple residents, the death of one resident does not necessarily end the lease or automatically release the remaining residents from their obligations. Remaining residents may continue to be responsible for rent, utilities, property condition, and other lease obligations under the terms of the lease agreement.

Because every lease and situation is different, Azure Sky Realty will review the circumstances and discuss available options with the remaining residents and property owner.

When multiple residents are parties to the lease, the death of one resident does not automatically terminate the lease. Remaining residents may continue to be responsible for rent, utilities, property condition, and all other obligations under the lease agreement. Because every situation is unique, Azure Sky Realty will review the circumstances and discuss available options with the remaining residents and property owner.

Death of a Sole Resident

When a resident is the only person named on the lease and passes away during the lease term, Texas law may provide certain rights regarding termination of the lease. Because these situations often involve family members, executors, administrators, or other authorized representatives, the specific requirements can vary depending on the circumstances.

Family members or authorized representatives should contact Azure Sky Realty as soon as practical following the resident's death. We may request documentation establishing authority to act on behalf of the resident or estate before discussing lease termination, access to the property, or removal of personal belongings.

Under the Texas Apartment Association Lease, a dwelling may be considered abandoned ten (10) days after the death of a sole resident. However, family members should not wait to contact us. Early communication allows us to discuss available options, coordinate access to the property, and help avoid misunderstandings regarding possession, personal property, rent obligations, and security deposits.

Because every situation is unique, Azure Sky Realty encourages surviving family members and authorized representatives to reach out directly so that we can provide guidance based on the specific circumstances.

The death of a sole resident does not automatically resolve all matters related to the tenancy. Depending on the circumstances, obligations relating to possession of the property, damages, utilities, cleaning, personal property, and other lease-related matters may continue after the resident's death. Family members and authorized representatives should contact Azure Sky Realty promptly so that we can explain the available options and documentation requirements.

Important: The death of one resident on a multi-resident lease is generally different from the death of a sole resident. If other residents remain on the lease, the lease may continue in effect and additional considerations may apply.

Personal Property and Possession of the Home

Following the death of a resident, family members are often concerned about accessing personal belongings and removing property from the home. Azure Sky Realty must balance these requests with privacy concerns, lease obligations, and legal requirements regarding possession of the property.

For that reason, personal property generally may only be released to authorized individuals who can demonstrate the legal authority to act on behalf of the deceased resident or with the consent of all remaining residents where applicable.

Residents and family members should not assume that access can be granted immediately without verification of authority.

Until authority has been established, Azure Sky Realty may be unable to provide access to the property, release keys, discuss account information, or authorize the removal of personal belongings.

Security Deposits and Financial Obligations

Security deposits are not automatically refunded upon the death of a resident. Deposits remain subject to the lease agreement and applicable law and are generally processed after possession of the property has been surrendered and the lease obligations have been resolved.

Any refund, if owed, may be payable to the estate of the deceased resident, surviving residents, or other parties entitled to receive the funds under applicable law and the lease agreement.
